Example Rental Agreement

 This Rental Agreement is between _______________________ (Renter) and Apartment Rue Monge (Company), for rental of the apartment located at xxx rue Monge, Paris (the Apartment) during the dates set out below.

 The parties agree as follows:

 1)       Rental Term:  Rental shall be from 3:00pm (or time otherwise agreed upon on page 1 of this document) on (arrival date) ______________ to 10:00am (or time otherwise agreed upon) on (departure date) _________.

 2)       Rental Fee: The rental fee for this term shall be $USD _________.  The rental fee is inclusive of all utilities (electricity, water, gas, garbage), and is inclusive of up to 10 units of local telephone use per day.  Pre-arrival and post-departure cleaning is included (see Cleaning, below, for details).

 3)       Deposits: All deposits must be paid in US currency.  A deposit of 50% of the total Rental Fee is required at the time of booking.  If the booking is made more than nine months in advance, a deposit of 20% is required at booking, with an additional deposit of 30% of the total Rental Fee 90 days prior to the beginning of the Rental Term.

 4)       Acknowledgement: About 2-4 weeks prior to departure, the Company will provide written acknowledgement of the booking and provide Client with a document (the Manual) describing how to get to the Apartment, how to get in, how to operate the appliances, etc.  Prior to this, Company and Client must agree on details of arrival.

 5)       Security Deposit:  A credit card is required for a security deposit.  If a credit card cannot be supplied, a security deposit of $USD 500 is required with the 90-day deposit.  The security deposit will be refunded in full within 60 days of the end of the Rental Term, provided there is no loss or damage to the apartment, and there have been no unpaid excess telephone charges.  A cleaning surcharge of $USD 100 will be deducted if the apartment is not left in a normal state of cleanliness upon departure.  The security deposit will pay for any loss or damage (beyond normal wear and tear) made by Client, or guests of Client, to any appliances, furniture, upholstery, kitchen utensils, linens, towels, etc., or to the apartment itself.  Single broken dishes, glasses, etc will not be charged if the breakage is reported to the Company during or immediately following the Rental Term. If loss or damage exceeds the security deposit, Client agrees to pay the excess costs in full. Client shall only be liable for loss or damage caused by Client or guests of Client.  Client shall be responsible for damage caused by client’s failure to adequately secure the apartment during the Rental Term and upon their departure.

 6)       Arrival and Departure:  Normal arrival and departure times are between 9am and 6pm.  A Company representative will greet you at the apartment upon arrival if we have your travel details.  A Company representative will arrive at the apartment prior to your departure to collect keys and inspect the state of the apartment.  In the case of arrival or departure outside of these hours, other arrangements will be made for access to the apartment and delivery of keys and access codes.  There may be an additional charge for these arrangements.

 7)       Final Payment: If Client is arriving during the normal arrival times, Final Payment may be made to the Company representative at that time.  Final Payment must be made in cash (Euros only), traveler’s checks (USD or Euros), or certified bank check (USD or Euros) drawn on either a US or a French bank.  Final Payment consists of the balance of the Rental Fee, any additional charges incurred up to that time, and the Security Deposit, if not already provided.  If Client is arriving at other than normal times, the Rental Fee and other charges must be received prior to arrival, and must be paid in US Funds.

 8)       Cancellation: Cancellations made six months or more before the Rental Term will be refunded in full, less $USD 20 for bank fees.  Cancellations made less than six months before the Rental Term shall forfeit the deposits made thus far, unless the apartment is re-rented for the period including the Rental Term.  Early departures shall not be due a refund, except if the apartment is re-rented.

 9)       Basic Terms: No Smoking of any kind is allowed in the apartment and will incur a $USD 200 cleaning surcharge against the security deposit.  No pets are allowed in the apartment.  More than seven persons, excepting children under the age of two years, may not occupy the Apartment.  The apartment is a residential dwelling and unreasonable noise (including operation of the washer/dryer) after 10pm is prohibited.  Disorderly or unruly behavior may result in the immediate termination of this Rental Agreement.  Rental is for personal use only, not for professional or business use.  The Company takes no responsibility for Client’s personal property left in the apartment either during the Rental Term or after departure.  Client shall not seek to recover damages from the Company for loss, damage or theft of personal property.

 10)   Keys: Two sets of keys to the apartment will be provided on arrival.  Loss of keys will incur a $USD 100 charge against the security deposit.

 11)   Cleaning: The apartment will be cleaned prior to the arrival date, and one set of clean linens and towels will be provided.  Normal and routine cleaning after departure is included in the Rental Fee.  Excess cleaning, including dirty dishes and major spills, shall incur a $USD 100 cleaning surcharge.  For multi-week stays, additional cleaning can be arranged at the Client’s expense, but is not included.

 12)   Company Access:  Client agrees to allow representatives of Company access to the apartment for inspection during daytime and early evening hours.  Client agrees, upon a 1 day notice, to allow any urgent work necessary in the apartment during daytime hours.

 13)   Termination: If this agreement is terminated by the Company because of unexpected unavailability of the apartment or any other reason prior to the Rental Term, all funds paid shall be refunded, but the Company incurs no other or additional liability.  If this agreement is terminated by the Company during the Rental Term because of violations of this Rental Agreement, or due to non-collectibility of funds, then the Company may evict the Client from the apartment without notice.

 14)    NO CONTRACT SHALL EXIST UNTIL A DEPOSIT AND A SIGNED RENTAL AGREEMENT ARE RECEIVED BY THE COMPANY FROM THE CLIENT.

 15)   Limitations of Liability: Under no circumstances shall the Company’s liability to the Client exceed the amount paid to the Company for the Rental Term. The Company shall not be liable to the Client for any temporary defect or stoppage in the supply of public services (electricity, gas, water) to the property, nor in respect of any equipment, plant, machinery or appliance in the property.  The Company shall not be liable for any loss, damage or injury which is the result of adverse weather conditions, civil unrest, strikes, Force Majeur or other matters beyond the control of the Company; nor for any loss, damage or inconvenience caused to or suffered by the client if the property is destroyed, substantially damaged or otherwise made uninhabitable during the Rental Term.

 16)   Entire Agreement:  This Agreement is the entire Agreement between Company and Client.  Any other communications are superseded by this Agreement.

The Client, undersigned, has read and agrees to the terms of this Rental Agreement, and wishes to make a booking for the Apartment rue Monge.  I am authorized to agree to the terms of this Rental Agreement on my own behalf and on behalf of all persons in my Party.
